Each confidentiality agreement defines its trade secrets, often referred to as „confidential information.“ This definition defines the purpose of the revelation. There are three common approaches to defining confidential information: (1) the use of a system for labelling all confidential information; (2) the list of trade secrets; or (3) to identify confidential information in a targeted manner. This information is confidential (as described in our confidentiality agreement) and this letter is intended to confirm the disclosure. Know-how does not always refer to secret information. Sometimes this means a certain type of technical knowledge that may not be confidential, but is necessary to accomplish a task. For example, a collaborator`s know-how may be required to train other collaborators in how to make or use an invention. Although know-how is a combination of secret and non-secret information, we recommend that you treat it as a protective trade secret.
